For more than sixty years, surgeons have used bioethical strategies to promote patient self‐determination, many of these now collectively described as “informed consent.” Yet the core framework—understanding, risks, benefits, and alternatives—fails to support patients in deliberation about treatment. We find that surgeons translate this framework into an overly complicated technical explanation of disease and treatment and an overly simplified narrative that surgery will “fix” the problem. They omit critical information about the goals and downsides of surgery and present untenable options (...) as a matter of patient choice. We propose a novel framework called “better conversations.” Herein, surgeons provide context about clinical norms, establish the goals of surgery, and comprehensively delineate the downsides of surgery to generate a deliberative space for patients to consider whether surgery is right for them. This paradigm shift meets the standards for informed consent, supports deliberation, and allows patients to anticipate and prepare for the experience of treatment. (shrink)

Procurement of organs from non-heart-beating cadaver donors raises concerns. Standards for optimal patient care during withdrawal of life-sustaining therapy are evolving and continue to be debated and studied. Consensus on specific procedures and methods has not been attained, however, and protocols for the procurement of organs from patients following the withdrawal of life-sustaining therapies may compromise the evolving standards and harm the patient and the attendant family. In addition, there is little evidence to suggest that such protocols will significantly increase (...) the number of organs procured. "Non-heart-beating cadaver" protocols that do not give comprehensive attention to optimal patient/family care at the time of withdrawal of life-sustaining therapy ought not to be endorsed. (shrink)

This article reviews the development of feminist studies during the latter quarter of the twentieth century, identifying initial themes in feminist theory and highlighting three major themes framing feminist scholarship today: the relationship between structure and agency; the intersection of race, class, and gender; and emerging studies of the political economy of sexuality. The article emphasizes the significance of understanding structured inequality, including new studies of sexuality and their relationship to race/class/gender stratification.

In this exploratory paper, we investigate the extension of Haidt’s :814–834, 2001, The righteous mind: Why good people are divided by politics and religion, 2012) Moral foundations theory, operationalized as the MFQ30 questionnaire, from a sample of the general public across many countries to a sample of business students. MFT posits that people rely on five major concerns, or foundations, when making moral judgments. The five concerns are care/harm, fairness/cheating, loyalty/betrayal, respect/authority, and purity/degradation. In addition, Haidt suggests that intuition, rather (...) than reasoning, leads to moral judgment. We replicate Haidt’s measurement model and find that the measurement model based on our sample is consistent. This indicates support for MFT. Further, we find structural differences in the measurement model between the genders and between areas of study. Our findings suggest that all students in the sample focus substantially on the fairness foundation. Ethics education and research may seek to expand the number of moral foundations individuals consider when discerning whether something is right or wrong. (shrink)

This article uses two national survey data sets to analyze the effects of skin color on life outcomes for African American and Mexican American women. Using a historical framework of European colonialism and slavery, this article explains how skin color hierarchies were established and are maintained. The concept of social capital is used to explain how beauty, defined through light skin, works as capital and as a stratifying agent for women on the dimensions of education, income, and spousal status. The (...) analysis shows that light skin predicts higher educational attainment for both groups of women. Light skin directly predicts higher personal earnings for African American women and indirectly affects personal earnings for Mexican American women. The use of psychometric tools to investigate the impact of school-based wellbeing programs raises a number of ethical issues around students’ rights, confidentiality and protection. Researchers have explicit ethical obligations to protect participants from potential psychological harms, but guidance is needed for effectively navigating disclosure of identifiable confidential information that indicates signs of psychological distress. Drawing on a large-scale study examining student, school, and system-based factors that impact the implementation of a school-based social and emotional learning program, we describe patterns (...) of distress attained from quantitative and qualitative questions and describe the process that we evolved to monitor and disclose sensitive mental health information, providing one example of how researchers might effectively address the responsibilities that emerge when collecting sensitive information from students within an education system. The patterns and processes that emerged illustrate that the inclusion of mental distress information can elicit important insights, but also brings responsibilities for minimising risks and maximising benefits. This study examined whether holding a status-consistent or status-inconsistent position affected the work satisfaction of college-educated, white-collar employees. The status-consistent group contained 128 women and 118 men. The status-inconsistent group was composed of 89 women and 102 men. Our results indicated that workers in occupations in which the majority of workers are the same gender had significantly higher levels of work satisfaction than those in status-inconsistent occupations. However, subsequent analyses revealed that men and women employed in occupations in which the (...) majority of workers are men had higher levels of work satisfaction than those employed in women-dominated occupations. These findings held when controlling for other work-satisfaction factors, such as individual earnings, hours worked per week, and length of time employed. We suggest that the effect of status consistency on work satisfaction is mediated by the cultural value attached to the occupations men dominate. (shrink)

Data from 590 college graduates are used to assess the relationship between family employment status and gender role attitudes for a predominately European American sample. The women in this study are employed full time, part time, or are full-time homemakers, and all report being married to men employed full time. The men in the study are all employed full time and report having wives who are employed full time, part time, or are full-time homemakers. Controlling for the effects of selected (...) background factors, full-time employed women are the most supportive of nontraditional family gender roles, followed by part-time employed women. The attitudes of homemakers are more similar to those of the men. Few significant differences exist when comparing the men with full-time employed wives, those with part-time employed wives, and men married to homemakers. The findings suggest an important link between work experiences, lifestyle choices, and gender role attitudes, particularly for women. (shrink)

Though assumptions about language underlie all bioethical work, the field has rarely partaken of theories of language. This article encourages a more linguistically engaged bioethics. We describe the tacit conception of language that is frequently upheld in bioethics—what we call the representational view, which sees language essentially as a means of description. We examine how this view has routed the field’s theories and interventions down certain paths. We present an alternative model of language—the pragmatic view—and explore how it expands and (...) clarifies traditional bioethical concerns. To lend concreteness, we apply the pragmatic view to a pervasive concept in bioethics and adjacent fields: decision making. We suggest that problems of the decision-making approach to bioethical issues are grounded in adherence to the representational view. Drawing on empirical work in surgery and critical care, we show how the pragmatic view productively reframes bioethical questions about how medical treatments are pursued. (shrink)

Background The ethical use both of human and non-human animals in research is predicated on the assumption that it is of a high quality and its projected benefits are more significant than the risks and harms imposed on subjects. Yet questions remain about whether and how IRBs and IACUCs should consider the scientific value of proposed research studies.Methods We draw upon 45 interviews with IRB and IACUC members and researchers with oversight experience about their perceptions of their own roles in (...) reviewing the quality and value of scientific protocols. Interview transcripts were memoed to highlight specific findings, which were then used to identify key themes through an iterative process.Results IRB and IACUC members expressed broad trust in the need for and value of research, and they often assumed that protocols had social value or that prior review, especially when associated with funding, affirmed both the rigor and merit of those protocols. Some oversight members also took an explicit stance against scientific review by stating that such review is not within the regulatory mandates governing their parts in the oversight system. Yet other interviewees expressed uneasiness about the current paradigm for evaluating the quality and overall value of science, suggesting that IRB and IACUC members perceive gaps in the oversight systems.Conclusions These findings reveal many similarities in how IRB and IACUC members understand the roles and limitations of their respective oversight committees. We conclude with a discussion of how the lack of a clear mandate regarding scientific review within US federal regulations may undermine ethical engagement of whether human and animal research is scientifically justified, resulting in a “mission lapse” wherein no organizational body is clearly responsible for ensuring that the research being conducted has the potential to advance science and benefit society. A limiting factor in ethics education in medical training has been difficulty in assessing competence in ethics. This study was conducted to test the concept that content analysis of pediatric residents’ personal reflections about ethics experiences can identify changes in ethical sensitivity and reasoning over time. Analysis of written narratives focused on two of our ethics curriculum’s goals: 1) To raise sensitivity to ethical issues in everyday clinical practice and 2) to enhance critical reflection on personal and professional values as (...) they affect patient care. Content analysis of written reflections was guided by a tool developed to identify and assess the level of ethical reasoning in eight domains determined to be important aspects of ethical competence. Based on the assessment of narratives written at two times (12 to 16 months/apart) during their training, residents showed significant progress in two specific domains: use of professional values, and use of personal values. Residents did not show decline in ethical reasoning in any domain. This study demonstrates that content analysis of personal narratives may provide a useful method for assessment of developing ethical sensitivity and reasoning. (shrink)

Teaching chemistry remains a profoundly challenging activity. This paper arises from reflection on the challenges of creating meaningful assessments. Herein a simple framework to assist in making more visible the different kinds of knowledge required for mastery of chemistry is described. Building from a realist foundation the purpose of this paper is to lay the intellectual scaffolding for the framework. By situating the framework theoretically, it is intended to highlight the value of engaging with philosophy for the project of knowledge (...) building in chemistry. Use of this framework has laid bare some significant limitations to the ways in which organic chemistry has been assessed. Making the visible to students aids in their engagement with knowledge and for a small minority has developed their understanding of science more generally. This interaction, which is based on critical realist ideas such as, for example, the transitive and intransitive dimensions of reality, affords a clear distinction between the practice of chemistry as science and the practice of chemistry as technology. The goals of this National Center for Biomedical Computing are to: create and maintain a repository of biomedical ontologies and terminologies; build tools and web services to enable the use of ontologies and terminologies in clinical and translational research; educate their trainees and the scientific community broadly about biomedical ontology and ontology-based technology and best practices; and collaborate with a variety of groups who develop and use ontologies and (...) terminologies in biomedicine. We hypothesize that black women experience accelerated biological aging in response to repeated or prolonged adaptation to subjective and objective stressors. Drawing on stress physiology and ethnographic, social science, and public health literature, we lay out the rationale for this hypothesis. We also perform a first population-based test of its plausibility, focusing on telomere length, a biomeasure of aging that may be shortened by stressors. Analyzing data from the Study of Women’s Health Across the Nation (SWAN), we estimate that at (...) ages 49–55, black women are 7.5 years biologically “older” than white women. Indicators of perceived stress and poverty account for 27% of this difference. Data limitations preclude assessing objective stressors and also result in imprecise estimates, limiting our ability to draw firm inferences. Further investigation of black-white differences in telomere length using large-population-based samples of broad age range and with detailed measures of environmental stressors is merited. (shrink)

Gaukroger claims that the roots of modernity lay in the (...) philosophies of Francis Bacon and René Descartes, both of whom regarded natural philosophy, rather than either moral philosophy or metaphysics, as the core of the philosophical enterprise. Whereas Bacon developed his ideas from a background steeped in the writings of the Renaissance humanists who emphasized moral philosophy, Descartes developed his ideas in the context of Scholastic philosophy, particularly the textbooks of the Jesuits that he had encountered at La Flèche and that located the foundations of philosophy in metaphysics.Regarding the unpublished early works, Le monde and L'homme, as suppressed parts of Descartes's mature project and taking seriously Descartes's stated intention of dealing with living things and humans along with the physical world in his natural philosophy, Gaukroger presents a detailed account of this "complete" version of the Principia philosophiae. In a series of six chapters, he explicates Descartes's views on the principles of knowledge, the principles of material objects, the visible universe, the Earth, living things, and man. Difficulties in reconciling Aristotelian natural philosophy and Christian theology, which had been formulated in terms of Aristotelian metaphysics, continued into the sixteenth century and provided the immediate background to the Jesuit commentaries and textbooks to which Descartes was exposed as a student. In these works, Jesuit philosophers attempted to derive a coherently unified Christian Aristotelianism from first principles. Gaukroger reminds us that Descartes's Principia philosophiae was a deliberate attempt to replace these Jesuit textbooks with one based on mechanistic principles.Despite the strength of Gaukroger's book as a contextualized study of a major philosophical figure who is frequently treated in an entirely ahistorical way, the book is not without its problems. The main problem is one that plagues many studies of Descartes (and other canonical figures in the history of philosophy), to wit, the presumption that he is somehow unique. For example, Gaukroger writes at length about Descartes's views about the differences between animals and humans with regard to cognition, arguing that Descartes did not consider animals to be automata because they lack rational souls but rather that they actually experience some but not all of the more abstract or reflexive forms of cognition usually ascribed to humans. Gaukroger does not mention the fact that many other early modern philosophers held a view like this. For example, Descartes's contemporary and fellow mechanical philosopher Pierre Gassendi claimed that animals could know universals, as when a dog recognizes that it is a human that is approaching, but differ from humans in not being capable of contemplating the nature of universality per se. Descartes was part of a community of thinkers concerned with similar problems, and his natural philosophy can be illuminated by viewing him in that context as well as against the backdrop of Scholasticism.Gaukroger underplays the significance of theology for Descartes's philosophy. Although he discusses how God's attributes, especially immutability, provide the basis for Descartes's laws of motion, he does not explore the specific aspects of Descartes's theological presuppositions and the way they influenced his entire natural philosophical project. This compact and innovative book tackles one of the central issues in drug policy: the lack of a coherent conceptual structure for thinking about drugs. Drugs generally fall into one of seven categories: prescription, over the counter, alternative medicine, common-use drugs like alcohol, tobacco and caffeine; religious-use, sports enhancement; and of course illegal street drugs like cocaine and marijuana. Our thinking and policies varies wildly from one to the other, with inconsistencies that derive more from cultural and social values than (...) from medical or scientific facts. Penalties exist for steroid use, while herbal remedies or cold medication are legal. Native Americans may legally use peyote, but others may not. Penalties may vary for using different forms of the same drug, such as crack vs. powder cocaine. Herbal remedies are unregulated by the FDA; but medical marijuana is illegal in most states. Battin and her contributors lay a foundation for a wiser drug policy by promoting consistency and coherency in the discussion of drug issues and by encouraging a unique dialogue across disciplines. The contributors are an interdisciplinary group of scholars mostly based at the University of Utah, and include a pharmacologist, a psychiatrist, a toxicologist, a trial court judge, a law professor, an attorney, a diatary specialist, a physician, a health expert on substance abuse, and Battin herself who is a philosopher. They consider questions like the historical development of current policy and the rationales for it; scientific views on how drugs actually cause harm; how to define the key notions of harm and addiction; and ways in which drug policy can be made more consistent. They conclude with an examination of the implications of a consistent policy for various disciplines and society generally. In 1996, President Clinton offered a promissory vision for human genetics when he said: “I think it won't be too many years before parents will be able to go home from the hospital with their newborn babies with a genetic map in their hands that will tell them, here's what your child's future will likely be like.”The rapid evolution of genetic sequencing technologies has advanced that vision. In October 2006, the cost of sequencing an entire human genome was $10.4 million; (...) by 2014 the cost had decreased a thousand fold. The term next generation sequencing describes a variety of laboratory methods that allow efficient determination of the precise order of nucleotides in a DNA sequence. The papers in this issue of the Journal of Law, Medicine & Ethics focus on “clinical NGS,” which refers to rapid DNA sequencing using second-, third- and fourth-generation sequencing technologies to perform genome-wide sequencing of multiple genes or alleles for clinical prognostic, diagnostic, and therapeutic purposes. This comparative field study evaluated the choices made by U.S., Portuguese, and Hong Kong Chinese evening MBA and graduating university business students when resolving business-related moral dilemmas. The authors developed hypotheses at the country level based on Hofstede’s ratings of each country’s national culture dimensions of power distance, uncertainty avoidance, individualism, and masculinity. The more individualistic U.S. respondents resolved the dilemmas with choices indicating less self-interest and more concern for unidentified others than did their Portuguese and Hong Kong Chinese counterparts, (...) who are from more collectivist societies. Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. Ample research links mothers’ postpartum depression (PPD) to adverse interactions with their infants. However, most studies relied on general population samples, whereas a substantial number of women are at elevated depression risk. The purpose of this study was to describe mothers’ interactions with their 6- and 12-month-old infants among women at elevated risk, although with a range of symptom severity. We also identified higher-order factors that best characterized the interactions and tested longitudinal consistency of these factors from 6 to 12 (...) months of infant age. We leveraged data from eight projects across the United States (n = 647), using standardized depression measures and an adaptation of the NICHD Mother-Infant Interaction Scales. Overall, these depression-vulnerable mothers showed high levels of sensitivity and positive regard and low levels of intrusiveness, detachment, and negative regard with their infants. Factor analyses of maternal behaviors identified two overarching factors—“positive engagement” and “negative intrusiveness” that were comparable at 6 and 12 months of infant age. Mothers’ ability to regulate depressed mood was a key behavior that defined “positive engagement” in factor loadings. An exceptionally strong loading of intrusiveness on the second factor suggested its central importance for women at elevated depression risk. Mothers with severe depressive symptoms had significantly more “negative intrusiveness” and less “positive engagement” with their 6-month-old infants than women with moderate or fewer depressive symptoms, suggesting a potential tipping point at which symptoms may interfere with the quality of care. Results provide the foundation for further research into predictors and moderators of women’s interactions with their infant among women at elevated risk for PPD. They also indicate a need for evidence-based interventions that can support more severely depressed women in providing optimal care. (shrink)

There are two fundamental self-regulatory systems for moral action reflecting an approach-oriented system promoting moral action (prescriptive morality) and an avoidance-oriented system restraining immoral action (proscriptive morality). Despite the presence of these systems, individuals may vary in the extent to which the systems regulate their moral responses. One factor that may heighten prescriptive and proscriptive moral self-regulation is individuals’ moral identity. Three studies examined if the systems of moral regulation are more salient among individuals with a strong internalized moral identity. (...) Possessing a strong internalized moral identity was associated with greater salience of the prescriptive system – with heightened perceptions that prescriptive behaviors should be enacted, that prescriptive behaviors are less a matter of personal preference, and that prescriptive behaviors are expected to yield greater social approval – compared to the proscriptive system. Possessing a strong internalized moral identity appears to orient individuals toward engaging in good (rather than only avoiding bad) behaviors. (shrink)

The account in Beauvoir’s Wartime Diary of her clandestine affair with Jacques Bost and sexual relationships with various young women challenges the conventional picture of Beauvoir as the devoted companion of Jean-Paul Sartre, just as her account of completing her novel She Came to Stay at a (...) time when Sartre’s philosophy in Being and Nothingness was barely begun calls into question the traditional view of Beauvoir’s novel as merely illustrating Sartre’s philosophy. Most important, the Wartime Diary provides an exciting account of Beauvoir’s philosophical transformation from the prewar solipsism of She Came to Stay to the postwar political engagement of The Second Sex. Cast in the crucible of the Nazi Occupation, Beauvoir’s existentialist ethics reflects dramatic collective experiences, such as joining the tide of refugees fleeing the German invasion in June 1940, as well as the courageous reaffirmation of her individuality in constructing a humanist ethics of freedom and solidarity in January 1941.
